Brain Quintenz to Resign from Kalshi’s Board Upon Taking Office as CFTC Commission Lead
Brain Quintenz, the nominee chosen by former President Trump to lead the Commodity Futures Trading Commission (CFTC), has made an announcement regarding his position on Kalshi’s board. Quintenz has revealed his intention to resign from his role at KalshiEx once he assumes office.
In a letter addressed to John Einstman, the designated agency ethics official for the Office of the General Counsel of the CFTC, Quintenz stated, “Upon confirmation, I will resign from my position with KalshiEx.” Additionally, he expressed his decision to divest all shares he holds in the prediction market platform, including unvested stock options.
Quintenz emphasized in the letter, “I will forfeit all KalshiEx stock options that are unvested at the time of my resignation. I will divest any vested stock options and stock in KalshiEx as soon as practicable, but not later than 90 days after my confirmation.” Furthermore, he declared his commitment to refrain from involvement in any matters related to Kalshi for at least the first year of his tenure.
The CFTC’s Stance on Sports Betting and Kalshi’s Market Expansion
Despite mounting pressure from state regulators and sports leagues urging the CFTC to address Kalshi’s foray into sports betting markets, the organization has maintained silence on the matter. Quintenz will be the only active commissioner among the five seats once he assumes his role, as the others have either departed or are in the process of doing so.
Under new leadership, the CFTC has displayed a favorable inclination towards the expansion of prediction markets. Previously, during the Biden administration, the CFTC had instructed Kalshi to remove its US president market. However, following a legal battle that resulted in a loss, Kalshi reinstated the market, garnering significant popularity among bettors.
This development marked the first instance of legal wagering by Americans on election outcomes. Subsequently, the CFTC withdrew its legal challenge, opening the door for future betting on elections. Notably, a candidate for California Governor, Kyle Langford, recently placed a bet on his own victory.
Kalshi’s Market Expansion and Growth
Building on the success of election markets, Kalshi expanded its offerings to include sports markets this year. While the company previously limited markets to futures, users can now predict outcomes of individual matches in major sports leagues such as NBA, NFL, MLB, and NHL. Additionally, Kalshi introduced a variety of March Madness markets in NCAA basketball, resulting in over $400 million in trading volume.
Further underscoring their growth, Kalshi reported $86 million in trades during the Masters tournament last month. In total, the platform processed approximately $1.97 billion in trading volume in 2024, a marked increase from $183 million in 2023. With the bustling activity in their sports markets, this figure is poised to rise further this year.
Presently, sports markets constitute over 75% of all markets on the platform. This shift has drawn criticism from tribal sportsbooks and state gambling regulators, with seven states issuing cease-and-desist letters to Kalshi. In response, Kalshi initiated legal action in New Jersey, Nevada, and Maryland, with plans for similar actions in other states.
Despite challenges, judges have ruled in favor of Kalshi, enabling operations to continue in New Jersey and Nevada. With Quintenz poised to lead the CFTC, it appears unlikely that significant challenges to Kalshi’s operations will succeed in the near future.
